General Terms and Conditions of Rental..

A contractual agreement is established upon booking/order confirmation with Event for Rent GmbH (hereinafter referred to as ‘Events4Rent’). These general terms and conditions form an integral part of this agreement and take precedence over any terms and conditions of the client.

1. Offers and prices

Unless otherwise stated, all offers made by Events4Rent are binding for 30 days from the date of the offer. The prices quoted are exclusive of any value added tax.

2. Contractual services

2.1 As a rule, the services provided by Events4Rent consist of being available for a specific event organised by the client for the agreed remuneration, with specific games equipment and a specific number of supervisors/operators for a specific period of time, including transport to and from the venue and set-up and dismantling.

2.2 The booking/order confirmation must specify the period during which the gaming equipment and support staff are to be available. If the client wishes to extend the gaming operation during the event, a proportional additional charge of CHF 50 per gaming equipment per hour will be made. Events4Rent remains free to determine whether or not an extension is possible.

2. 3 Under no circumstances may gambling for money or valuables take place at the event.

2.4 Events4Rent is entitled, for important reasons, to change the agreed contractual service in accordance with the order confirmation (e.g. in the event of the failure of certain game equipment) if this does not adversely affect the value of the service for the client (e.g. through alternative game equipment) . Such changes may only be made to a minor extent. In any case, however, if and to the extent that questions arise regarding changes to the provision of services, the parties shall endeavour to resolve these in advance and make adjustments.

2.5 The transfer of rights and obligations under this contract by the client to third parties is only possible with the written consent of Events4Rent.

3. Terms of payment

The amount for the services provided by Events4Rent is to be paid in cash on site or by bank transfer 30 days before the event.

The cost of food and drink for the staff provided for the operation of the games shall be borne by the client. This does not include alcoholic beverages.

4. Obligations of the client

4.1 The client shall ensure that the necessary conditions and requirements are in place in terms of location, space and time so that Events4Rent can provide its services.

Unless and insofar as otherwise agreed, the client shall in particular be responsible for the event venue and for ensuring that Events4Rent has sufficient time for set-up and dismantling.

The following must be observed in particular:

Before the event

The client is responsible for taking out any necessary event organiser’s liability insurance, unless and insofar as this is already covered by business liability insurance.

The client shall inform Events4Rent in good time of everything that is relevant to the execution of the order, in particular by providing the full address of the event venue, details of the premises/restrictions, access options (such as entrance, lift size, transport lifts, room sizes, any stairs or other obstacles, etc.).

For assembly and dismantling

The client shall ensure that Events4Rent has suitable loading and unloading facilities at the event location, can use an existing lift, etc. If and to the extent that it becomes apparent at the event that loading and unloading facilities are not guaranteed or that timely access to the event premises is denied, the client shall bear this risk.

As a rule, set-up takes one hour before the start of the event. Dismantling takes one hour after the end of the event.

Electricity (possibly detailed) must be available at the event location;

The client shall ensure that an instructed contact person is on site before set-up.

During the event

The client must treat the Events4Rent inventory with care and is responsible for ensuring that the event guests behave accordingly. For its part, Events4Rent must treat the event venue with the utmost care, especially during set-up and dismantling, and must follow instructions.

If and to the extent that one of the parties violates its obligations, it shall be liable for this.

5. Client’s right of withdrawal / contract adjustments

5.1 The client may withdraw from the contract at any time before the start of the event. Withdrawal must be made in writing to Events4Rent. The date of receipt of the notice of withdrawal shall be decisive for the date of withdrawal.

5.2 The following cancellation fees apply, which Events4Rent is entitled to from the agreed fee

  • Cancellation up to 40 days before the event 20%
  • Cancellation between 39 and 15 days before the event 40%
  • Cancellation 14 days to 4 days before the event 60%
  • Cancellation from three days before the event 80%.

5.3 Any other adjustment to the agreed services (such as postponement of the event date, change of game equipment and personnel, etc.) is only possible on the basis of a written contract amendment/supplement by mutual agreement.

6. Liability of Event for Rent GmbH

6.1 Events4Rent shall only be liable for itself and its personnel in cases of intent or gross negligence, but then without limitation.

6.2 Events4Rent has taken out public liability insurance which also covers damages caused by assembly and dismantling in cases of existing liability.

6.3 Any impossibility of performance for which the client is responsible (such as the venue not being available, no power connection, inaccessibility, insufficient space) shall be at the client’s expense.

7. Liability of the client

The client is liable to Events4Rent for all damage or loss of Events4Rent’s inventory that occurs during the event and is attributable to the behaviour of the client or their guests.

8. Further provisions

Events4Rent is entitled to list the contractor on its homepage, in advertising, etc. as a reference and to use photos of the event accordingly. The contractor may revoke this by unilateral declaration no later than 10 days after the event.

9. Applicable law

The legal relationship between the parties is governed exclusively by Swiss law. The exclusive place of jurisdiction is Münchwilen TG.
